Wills, Trusts and Guardianship Workshop

Donna Neff, an Ottawa wills and estates lawyer, was the speaker for a Wills, Trusts and Guardianship Workshop intended for the families of someone with a disability. Designed to provide important estate planning information for those who have a relative with a disability, Donna reviewed in clear, understandable language the kinds of documents that should be prepared and signed and why they are so important. She also explained the difference between acting under a Power of Attorney versus a Guardianship Order, and how to manage the assets and income of someone with a disability while protecting the person’s right to income and other supports from government sources such as the Ontario Disability Support Plan (ODSP). Donna also discussed Henson trusts and discretionary expense trusts which are allowed by ODSP Regulations and explained how these types of trusts differ and when each is available and most useful.
